The association of large French companies and public administrations that use digital solutions and services, Cigref, and the professional association of digital services companies (ESN), Syntec Numérique, "solemnly call on their members to understand the difficulties that each of them may encounter in these exceptional circumstances, and to show professional solidarity, especially towards the weakest, and to anticipate".
"The digital sector is not spared by the economic consequences of the health crisis. Many companies whose activity, in recent weeks, has been significantly reduced, or even simply cancelled, have been forced to resort, within their digital departments, to short-time working measures, to the stopping of IT projects, to the postponement of service contracts in management or fixed price".Six principles of contractual relations in times of crisis
The two organizations propose " six principles for contractual relations in this time of crisis in Covid-19:- principle of resilience: "whenever possible, and to the extent necessary, each party shall take all measures at its disposal to honor existing contracts
- principle of proportionality: modifications or cancellations of contracts "must be proportionate to the stakes of loss of turnover in connection with the health crisis, avoiding any windfall effect".
- gradualness principle: principals and service providers define "gradual load reduction plans" and prepare the exit from the crisis together
- principle of differentiation: contract modifications or terminations should "favour the maintenance of activity of the most fragile" providers
- principle of responsibility: "the respect, or even the reduction, of payment periods" is "an absolute necessity".
- principle of solidarity: providers are "attentive to the conditions for preserving the capacity of their clients to emerge from the crisis and return to regular activity".
