Databases benefit from a double legal protection:
the protection of the structure of the database by copyright, on the one hand,
the protection of the contents of the database by the so-called "sui generis" right of the database producer, on the other hand.
It will then be necessary to study the initial ownership of the copyright and the sui generis right on the databases.
Definition of a database in copyright law
Article L. 112-3, paragraph 2, of the Intellectual Property Code defines a database as " a collection of works, data or other independent elements, arranged in a systematic or methodical manner, and individually accessible by electronic means or by any other means". The Court of Justice of the European Union has, in this respect, specified that the database must be made up of elements that are "separable from one another without the value of their contents being affected" and that are arranged according to a "method or system, of whatever nature, which makes it possible to find each of its constituent elements".
